Protecting retirees from abuse is very important. Protecting conscious patients from being placed in state-run nursing homes, which are at best staffed at a level that's adequate to handle only semiconscious patients, is extremely important. Allowing empty-nesters to open their homes to, say, two of Grandma's friends along with Grandma is a valuable way of keeping Grandma's friends from being unnecessarily institutionalized, and potentially extending the length and enhancing the quality of their lives. Instead of making this kind of private initiative a crime, we need to keep the burden of proof on anyone who alleges that Grandma's friends aren't being adequately cared for by Grandma's children.
