SB 800, 1279, HB 2048: Opposition to New Taxes

This document came in from three different sources this morning, showing that several Virginians feel very strongly about new taxes, tax increases, Obamacare, and Agenda 21. While I've been rejoicing that we have a budget, some contributors to this web site have taken the time to go over the budget, and found significant problems with it. All links have been checked and found legitimate:

The Governor's sales tax hike has passed the House - YOU will pay the 2 Billion that HB2313 will raise for transportation over the next five years. BTW...that 2 Billion includes a few things like Dulles rail (which "We The People" don't want), mass transit projects (that "We The People" don't want), tolls are still an option and you will pay another $15 on your annual car registrations. That's just for starters....
As soon as Congress passes the Internet tax, our Governor is counting on a billion dollars from that Federal kitty. Really? What if that never shows up?

BTW....still no lock box for transportation funds.
We have a spending problem, not a revenue problem!

Obamacare comes to Virginia
The Senate has passed the Medicaid expansion - your taxes will have to go up in 5 years to pay for the 400,000 estimated new Medicaid patients after the Federal money runs out! The amendment to SB800 is attached!

Call your Delegate and tell him to vote NO on SB800 if it includes the Medicaid expansion. House Member Listings

Agenda 21 on Steroids:

Department of Environmental Quality ( DEQ ) is going to be taking over Department of Conservation and Recreation ( DCR ) Both houses have passed a substitute bill (HB2048 & SB1279). Now there will be a conference committee followed by an up or down vote in each house. The only question is: Will it be the 93 page monster or the 59 page one? Local BOS members are already being warned that there are going to be a lot of changes. "So get ready"! This merger removes the checks and balances that protect land owners and stormwater will be defined as Nonpoint Source pollution.
From the Senate substitute Feb. 7th.
line 3053 "Nonpoint Source pollution" means pollution such as sediment, nitrogen, phosphorus, hydrocarbons,

3054 heavy metals, and toxics whose sources cannot be pinpointed but rather are washed from the land

3055 surface in a diffuse manner by stormwater runoff.
3069 "Stormwater" means precipitation that is discharged across the land surface or through conveyances

3070 to one or more waterways and that may include storm water runoff, snow melt runoff, and surface
3071 runoff and drainage.

3072 "Stormwater management plan" means a document containing material describing methods for
3073 complying with the requirements of a VSMP

Money is still being handed out to special interests......over 100 new giveaways were introduced. While they have one hand in your pocket for more tax money, the other hand is giving away more tax credits and tax breaks. What about the 1.3 Billion in surpluses over the last 3yrs? Were did that go? It obviously needs to go to transportation. We have a spending problem!

The budget still grows year after year!
When is the last time these guys were in a grocery store? Don't they read the paper? Didn't they hear about the Federal tax hikes in January? Surely they know what is headed our way through 0bamacare?

These guys need to get on a bus!

Page 280, after line 14, insert:

"JJJJ. 1. The Department of Medical Assistance Services shall seek federal
authority through the necessary waiver(s) and/or State Plan authorization under
Titles XIX and XXI of the Social Security Act to ensure that for newly eligible
individuals who would be covered consistent with the federal Patient Protection
and Affordable Care Act (PPACA) a) the services and benefits provided are
similar to the services and benefits provided by commercial insurers with the
exception of non-traditional behavioral health and substance use disorder services,
b) reasonable limitations on non-essential benefits such as transportation are
implemented, and c) patient responsibility is required including reasonable costsharing
and active engagement in health and wellness activities to improve health
and control costs.

2. Contingent upon approval of the conditions in paragraph 1, the Department of
Medical Assistance Services shall have authority to amend the State Plans for
Medical Assistance under Titles XIX and XXI of the Social Security Act, and any
waivers thereof, to implement requirements of (PPACA) as it pertains to the
expansion of Medicaid eligibility. There is hereby appropriated sum sufficient
nongeneral funds for this purpose.

3. A. There is hereby created in the state treasury a special nonreverting fund to
be known as the Virginia Health Reform and Innovation Fund, hereafter referred to
as the "Fund." The Fund shall be established on the books of the Comptroller and
any moneys remaining in the Fund at the end of each fiscal year shall not revert to
the general fund but shall remain in the Fund. For purposes of the Comptroller's
preliminary and final annual reports required by § 2.2-813, however, all deposits to
and disbursements from the Fund shall be accounted for as part of the general fund
of the state treasury.

B. The Director of the Department of Medical Assistance Services, in consultation
with the Director of the Department of Planning and Budget, shall identify general
fund savings from behavioral health services, inmate health care, and indigent care,
attributable to the expansion of Medicaid eligibility consistent with the PPACA,
and transfer the savings into the state treasury and deposit them to the Fund.

Interest earnings generated by the Fund shall be made available for health
innovation grants to private and public entities in order to reduce the annual rate of
growth in health care spending in the Commonwealth by no less than one percent.

Explanation:

(Contingent upon federal approval of specific Medicaid reforms, this
amendment authorizes the expansion of Medicaid coverage consistent with the
Affordable Care Act and provides a sum sufficient appropriation for that purpose.

Prior to an expansion of coverage, the Department of Medical Assistance Services
must seek assurance that a) the services and benefits provided would be similar to
the services and benefits provided by commercial insurers with the exception of
non-traditional behavioral health and substance use disorder services, b) reasonable
limitations on non-essential benefits such as transportation are implemented, and c)
patient responsibility is required including reasonable cost-sharing and active
engagement in health and wellness activities to improve health and control costs.

Budget language creates the Health Reform and Innovation Fund with general fund
savings from state agencies. General fund savings estimated at $52.1 million in
FY 2014 are expected to come from behavioral health services, inmate inpatient
care, and indigent care, as federal dollars are substituted for current state spending.
